By accessing this website we assume you accept these terms and conditions. Do not continue to use AllerGenius if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to AllerGenius. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, prevailing law of the United Kingdom. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

2. License to Use

Unless otherwise stated, AllerGenius and/or its licensors own the intellectual property rights for all material on AllerGenius. All intellectual property rights are reserved. You may access this from AllerGenius for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

• Republish material from AllerGenius
• Sell, rent or sub-license material from AllerGenius
• Reproduce, duplicate or copy material from AllerGenius
• Redistribute content from AllerGenius

This Agreement shall begin on the date hereof.

3. Service Description

AllerGenius provides a digital allergen management platform for food establishments. Our service allows businesses to create digital menus with allergen information, manage and update allergen data, and provide this information to customers in a user-friendly format.

While we strive to ensure that the information displayed through our platform is accurate and up-to-date, we rely on the information provided by our users. AllerGenius does not independently verify the accuracy of allergen information input by users, and we cannot guarantee that the information is complete, accurate, or up-to-date.

4. Accuracy of Information

The content on the AllerGenius platform is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our platform.

Although we make reasonable efforts to update the information on our platform, we make no representations, warranties or guarantees, whether express or implied, that the content on our platform is accurate, complete or up-to-date.

As a food business using our platform, you remain responsible for ensuring the accuracy of allergen information provided to your customers and for complying with all applicable food safety and allergen labeling laws and regulations in your jurisdiction.

5. Subscriptions and Payments

Some of our services require payment of fees. If you sign up for a subscription plan:

• You agree to pay all fees associated with the plan you select.
• Subscription fees are charged at the beginning of your subscription and upon each renewal until canceled.
• You authorize us to store your payment method and to automatically charge your payment method on a recurring basis.
• Subscriptions automatically renew until canceled.
• You can cancel your subscription at any time via your account settings or by contacting us directly.

All prices listed on our website are exclusive of VAT or any other applicable sales taxes, unless otherwise stated.

6. Refund Policy

Our refund policy is as follows:

• We offer a 14-day money-back guarantee for new subscriptions if you are not satisfied with our service.
• To request a refund, contact us at info@allergenius.co.uk within 14 days of your initial purchase.
• We do not offer prorated refunds for canceled subscriptions after the 14-day period.
• We reserve the right to refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behavior.

7. Account Registration and Security

To use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AllerGenius, its affiliates, agents, directors, employees, suppliers or licensors be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, this service.

Without limiting the foregoing, to the maximum extent permitted by applicable law, AllerGenius's total liability to you for all claims is limited to the amount you paid us to use the service in the 12 months before the claim arose.

The limitations of damages set forth above are fundamental elements of the basis of the bargain between AllerGenius and you.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

9. Indemnification

You agree to defend, indemnify and hold harmless AllerGenius, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Service, including, but not limited to, your User Contributions, any use of the Service's content, services and products other than as expressly authorized in these Terms of Service or your use of any information obtained from the Service.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service, or contact us directly at allergenius@removenture.com.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
